1. ÚVODNÍ USTANOVENÍ
1.1. Tyto obchodní podmínky (dále jen „obchodní podmínky“) obchodní společnosti La Candela s.r.o., se sídlem Melantrichova 18, 110 00 Praha 1, identifikační číslo: 26146487, zapsané v obchodním rejstříku vedeném Městským soudem v Praze, (dále jen „prodávající“) upravují v souladu s ustanovením § 1751 odst. 1 zákona č. 89/2012 Sb., občanský zákoník (dále jen „občanský zákoník“) vzájemná práva a povinnosti smluvních stran vzniklé v souvislosti nebo na základě kupní smlouvy (dále jen „kupní smlouva“) uzavírané mezi prodávajícím a jinou fyzickou osobou (dále jen „kupující“) prostřednictvím internetového obchodu prodávajícího. Internetový obchod je prodávajícím provozován na webové stránce umístněné na internetové adrese shosexmachinesmuseum.com(dále jen „webová stránka“), a to prostřednictvím rozhraní webové stránky (dále jen „webové rozhraní obchodu“).
1.2. Obchodní podmínky se nevztahují na případy, kdy osoba, která má v úmyslu nakoupit zboží od prodávajícího, je právnickou osobou či osobou, jež jedná při objednávání zboží v rámci své podnikatelské činnosti nebo v rámci svého samostatného výkonu povolání.
1.3. Ustanovení odchylná od obchodních podmínek je možné sjednat v kupní smlouvě. Odchylná ujednání v kupní smlouvě mají přednost před ustanoveními obchodních podmínek.
1.4. Ustanovení obchodních podmínek jsou nedílnou součástí kupní smlouvy. Kupní smlouva a obchodní podmínky jsou vyhotoveny v českém jazyce. Kupní smlouvu lze uzavřít v českém jazyce.
1.5. Znění obchodních podmínek může prodávající měnit či doplňovat. Tímto ustanovením nejsou dotčena práva a povinnosti vzniklá po dobu účinnosti předchozího znění obchodních podmínek.
2. UŽIVATELSKÝ ÚČET
2.1. Na stránkách provozovatele eshopu, spol. La Candela s.r.o. není pro nákup potřeba povinné registrace, zadávané údaje slouží vždy a pouze pro vyřízení samotné objednávky a nikdy nejsou předávány třetím stranám, vyjma provozovatele poštovních/přepravních služeb.
3. UZAVŘENÍ KUPNÍ SMLOUVY
3.1. Veškerá prezentace zboží umístěná ve webovém rozhraní obchodu je informativního charakteru a prodávající není povinen uzavřít kupní smlouvu ohledně tohoto zboží. Ustanovení § 1732 odst. 2 občanského zákoníku se nepoužije.
3.2. Webové rozhraní obchodu obsahuje informace o zboží, a to včetně uvedení cen jednotlivého zboží. Ceny zboží jsou uvedeny včetně daně z přidané hodnoty a všech souvisejících poplatků mimo poštovného. Ceny zboží zůstávají v platnosti po dobu, kdy jsou zobrazovány ve webovém rozhraní obchodu. Tímto ustanovením není omezena možnost prodávajícího uzavřít kupní smlouvu za individuálně sjednaných podmínek.
3.3. Webové rozhraní obchodu obsahuje také informace o nákladech spojených s balením a dodáním zboží do zemí, uvedených v seznamu včetně České republiky, Slovenské republiky, EU i mimo EU.
3.4. Pro objednání zboží vyplní kupující objednávkový formulář ve webovém rozhraní obchodu. Objednávkový formulář obsahuje zejména informace o:
3.4.1. objednávaném zboží (objednávané zboží „vloží“ kupující do elektronického nákupního košíku webového rozhraní obchodu),
3.4.2. způsobu úhrady kupní ceny zboží, údaje o požadovaném způsobu doručení objednávaného zboží a
3.4.3. informace o nákladech spojených s dodáním zboží (dále společně jen jako „objednávka“).
3.5. Před zasláním objednávky prodávajícímu je kupujícímu umožněno zkontrolovat a měnit údaje, které do objednávky kupující vložil, a to i s ohledem na možnost kupujícího zjišťovat a opravovat chyby vzniklé při zadávání dat do objednávky. Objednávku odešle kupující prodávajícímu kliknutím na tlačítko „Confirm Order“. Údaje uvedené v objednávce jsou prodávajícím považovány za správné a objednávka je vždy považována za závaznou.
3.6. Odeslání objednávky se považuje za takový úkon kupujícího, který nepochybným způsobem identifikuje objednávané zboží, kupní cenu, osobu kupujícího, způsob úhrady kupní ceny, a je pro smluvní strany závazným návrhem kupní smlouvy. Podmínkou platnosti objednávky je vyplnění všech povinných údajů v objednávkovém formuláři, seznámení se s těmito obchodními podmínkami na webové stránce a potvrzení kupujícího o tom, že se s těmito obchodními podmínkami seznámil.
3.7. Prodávající neprodleně po obdržení objednávky toto obdržení kupujícímu potvrdí elektronickou poštou, a to na adresu elektronické pošty kupujícího uvedenou v uživatelském rozhraní či v objednávce (dále jen „elektronická adresa kupujícího“).
3.8. Prodávající je vždy oprávněn v závislosti na charakteru objednávky (množství zboží, výše kupní ceny, předpokládané náklady na dopravu) požádat kupujícího o dodatečné potvrzení objednávky (například písemně či telefonicky).
3.9. Návrh kupní smlouvy ve formě objednávky má platnost patnáct dnů.
3.10. Smluvní vztah mezi prodávajícím a kupujícím vzniká doručením přijetí objednávky (akceptací), jež je prodávajícím zasláno kupujícímu elektronickou poštou, a to na adresu elektronické pošty kupujícího.
3.11. V případě, že některý z požadavků uvedených v objednávce nemůže prodávající splnit, zašle kupujícímu na elektronickou adresu kupujícího pozměněnou nabídku s uvedením možných variant objednávky a vyžádá si stanovisko kupujícího.
3.12. Pozměněná nabídka se považuje za nový návrh kupní smlouvy a kupní smlouva je v takovém případě uzavřena až akceptací kupujícího prostřednictvím elektronické pošty.
3.13. Kupující souhlasí s použitím komunikačních prostředků na dálku při uzavírání kupní smlouvy. Náklady vzniklé kupujícímu při použití komunikačních prostředků na dálku v souvislosti s uzavřením kupní smlouvy (náklady na internetové připojení, náklady na telefonní hovory) si hradí kupující sám, přičemž tyto náklady se neliší od základní sazby.
4. CENA ZBOŽÍ A PLATEBNÍ PODMÍNKY
4.1. Cenu zboží a případné náklady spojené s dodáním zboží dle kupní smlouvy může kupující uhradit prodávajícímu následujícími způsoby:
platební kartou.
4.2. Společně s kupní cenou je kupující povinen zaplatit prodávajícímu také náklady spojené s balením a dodáním zboží ve smluvené výši. Není-li uvedeno výslovně jinak, rozumí se dále kupní cenou i náklady spojené s dodáním zboží.
4.3. Prodávající nepožaduje od kupujícího zálohu či jinou obdobnou platbu. Tímto není dotčeno ustanovení čl. 4.6 obchodních podmínek ohledně povinnosti uhradit kupní cenu zboží předem.
4.4. Prodávající je oprávněn, zejména v případě, že ze strany kupujícího nedojde k dodatečnému potvrzení objednávky (čl. 3.8), požadovat uhrazení celé kupní ceny ještě před odesláním zboží kupujícímu. Ustanovení § 2119 odst. 1 občanského zákoníku se nepoužije.
4.5. Případné slevy z ceny zboží poskytnuté prodávajícím kupujícímu nelze vzájemně kombinovat.
4.6. Je-li to v obchodním styku obvyklé nebo je-li tak stanoveno obecně závaznými právními předpisy, vystaví prodávající ohledně plateb prováděných na základě kupní smlouvy kupujícímu daňový doklad – fakturu. Prodávající je plátcem daně z přidané hodnoty. Daňový doklad – fakturu vystaví prodávající kupujícímu po uhrazení ceny zboží a zašle jej v elektronické podobě na elektronickou adresu kupujícího a kopii přiloží k objednanému zboží.
5. ODSTOUPENÍ OD KUPNÍ SMLOUVY
5.1. Kupující bere na vědomí, že dle ustanovení § 1837 občanského zákoníku, nelze mimo jiné odstoupit od kupní smlouvy u dodávky zboží, které bylo upraveno podle přání kupujícího nebo pro jeho osobu
5.2. Nejedná-li se o tento případ uvedený či o jiný případ, kdy nelze od kupní smlouvy odstoupit, má kupující v souladu s ustanovením § 1829 odst. 1 občanského zákoníku právo od kupní smlouvy odstoupit, a to do čtrnácti (14) dnů od převzetí zboží, přičemž v případě, že předmětem kupní smlouvy je několik druhů zboží nebo dodání několika částí, běží tato lhůta ode dne převzetí poslední dodávky zboží. Odstoupení od kupní smlouvy musí být prodávajícímu odesláno ve lhůtě uvedené v předchozí větě.
5.3. Pro odstoupení od kupní smlouvy může kupující využit vzorový formulář poskytovaný prodávajícím, jenž tvoří přílohu obchodních podmínek. Odstoupení od kupní smlouvy může kupující zasílat mimo na adresu provozovny nebo sídla prodávajícího. Pro doručování odstoupení od smlouvy platí ustanovení čl. 11 těchto obchodních podmínek. Podnikatel potvrdí spotřebiteli bez zbytečného odkladu v textové podobě jeho přijetí.
5.4. V případě odstoupení od kupní smlouvy dle čl. 5.2 obchodních podmínek se kupní smlouva od počátku ruší. Zboží musí být prodávajícímu vráceno do čtrnácti (14) dnů od odstoupení od smlouvy prodávajícímu. Odstoupí-li kupující od kupní smlouvy, nese kupující náklady spojené s navrácením zboží prodávajícímu, a to i v tom případě, kdy zboží nemůže být vráceno pro svou povahu obvyklou poštovní cestou.
5.5. V případě odstoupení od smlouvy dle čl. 5.2 obchodních podmínek vrátí prodávající peněžní prostředky přijaté od kupujícího do čtrnácti (14) dnů od odstoupení od kupní smlouvy kupujícím, a to stejným způsobem, jakým je prodávající od kupujícího přijal. Prodávající je taktéž oprávněn vrátit plnění poskytnuté kupujícím již při vrácení zboží kupujícím či jiným způsobem, pokud s tím kupující bude souhlasit a nevzniknou tím kupujícímu další náklady. Odstoupí-li kupující od kupní smlouvy, prodávající není povinen vrátit přijaté peněžní prostředky kupujícímu dříve, než mu kupující zboží vrátí nebo prokáže, že zboží prodávajícímu odeslal.
5.6. Nárok na úhradu škody vzniklé na zboží je prodávající oprávněn jednostranně započíst proti nároku kupujícího na vrácení kupní ceny.
5.7. Do doby převzetí zboží kupujícím je prodávající oprávněn kdykoliv od kupní smlouvy odstoupit. V takovém případě vrátí prodávající kupujícímu kupní cenu bez zbytečného odkladu, a to bezhotovostně na účet určený kupujícím.
5.8. Je-li společně se zbožím poskytnut kupujícímu dárek, je darovací smlouva mezi prodávajícím a kupujícím uzavřena s rozvazovací podmínkou, že dojde-li k odstoupení od kupní smlouvy kupujícím, pozbývá darovací smlouva ohledně takového dárku účinnosti a kupující je povinen spolu se zbožím prodávajícímu vrátit i poskytnutý dárek.
6. PŘEPRAVA A DODÁNÍ ZBOŽÍ
6.1. Zboží expedujeme nejpozději do 5 pracovních dnů od přijetí objednávky.
6.2. V případě, že je způsob dopravy smluven na základě zvláštního požadavku kupujícího, nese kupující riziko a případné dodatečné náklady spojené s tímto způsobem dopravy.
6.3. Je-li prodávající podle kupní smlouvy povinen dodat zboží na místo určené kupujícím v objednávce, je kupující povinen převzít zboží při dodání.
6.4. V případě, že je z důvodů na straně kupujícího nutno zboží doručovat opakovaně nebo jiným způsobem, než bylo uvedeno v objednávce, je kupující povinen uhradit náklady spojené s opakovaným doručováním zboží, resp. náklady spojené s jiným způsobem doručení.
6.5. Při převzetí zboží od přepravce je kupující povinen zkontrolovat neporušenost obalů zboží a v případě jakýchkoliv závad toto neprodleně oznámit přepravci. V případě shledání porušení obalu svědčícího o neoprávněném vniknutí do zásilky nemusí kupující zásilku od přepravce převzít.
7. PRÁVA Z VADNÉHO PLNĚNÍ
7.1. Práva a povinnosti smluvních stran ohledně práv z vadného plnění se řídí příslušnými obecně závaznými předpisy (zejména ustanoveními § 1914 až 1925, § 2099 až 2117 a § 2161 až 2174 občanského zákoníku).
7.2. Prodávající odpovídá kupujícímu, že zboží při převzetí nemá vady. Zejména prodávající odpovídá kupujícímu, že v době, kdy kupující zboží převzal:
7.2.1. má zboží vlastnosti, které si strany ujednaly, a chybí-li ujednání, má takové vlastnosti, které prodávající nebo výrobce popsal nebo které kupující očekával s ohledem na povahu zboží a na základě reklamy jimi prováděné,
7.2.2. se zboží hodí k účelu, který pro jeho použití prodávající uvádí nebo ke kterému se zboží tohoto druhu obvykle používá,
7.2.3. zboží odpovídá jakostí nebo provedením smluvenému vzorku nebo předloze, byla-li jakost nebo provedení určeno podle smluveného vzorku nebo předlohy,
7.2.4. je zboží v odpovídajícím množství, míře nebo hmotnosti a
7.2.5. zboží vyhovuje požadavkům právních předpisů.
7.3. Ustanovení uvedená v čl. 7.2 obchodních podmínek se nepoužijí u zboží prodávaného za nižší cenu na vadu, pro kterou byla nižší cena ujednána, na opotřebení zboží způsobené jeho obvyklým užíváním, u použitého zboží na vadu odpovídající míře používání nebo opotřebení, kterou zboží mělo při převzetí kupujícím, nebo vyplývá-li to z povahy zboží.
7.4. Projeví-li se vada v průběhu šesti měsíců od převzetí, má se za to, že zboží bylo vadné již při převzetí.
7.5. Práva z vadného plnění uplatňuje kupující u prodávajícího na adrese jeho provozovny, v níž je přijetí reklamace možné s ohledem na sortiment prodávaného zboží, případně i v sídle nebo místě podnikání. Za okamžik uplatnění reklamace se považuje okamžik, kdy prodávající obdržel od kupujícího reklamované zboží.
7.6. Další práva a povinnosti stran související s odpovědností prodávajícího za vady může upravit reklamační řád prodávajícího.
8. DALŠÍ PRÁVA A POVINNOSTI SMLUVNÍCH STRAN
8.1. Kupující nabývá vlastnictví ke zboží zaplacením celé kupní ceny zboží
8.2. Prodávající není ve vztahu ke kupujícímu vázán žádnými kodexy chování ve smyslu ustanovení § 1826 odst. 1 písm. e) občanského zákoníku.
8.3. K mimosoudnímu řešení spotřebitelských sporů z kupní smlouvy je příslušná Česká obchodní inspekce, se sídlem Štěpánská 567/15, 120 00 Praha 2, IČ: 000 20 869, internetová adresa: http://www.coi.cz
8.4. Prodávající je oprávněn k prodeji zboží na základě živnostenského oprávnění. Živnostenskou kontrolu provádí v rámci své působnosti příslušný živnostenský úřad. Dozor nad oblastí ochrany osobních údajů vykonává Úřad pro ochranu osobních údajů. Česká obchodní inspekce vykonává ve vymezeném rozsahu mimo jiné dozor nad dodržováním zákona č. 634/1992 Sb., o ochraně spotřebitele, ve znění pozdějších předpisů.
8.5. Kupující tímto přebírá na sebe nebezpečí změny okolností ve smyslu § 1765 odst. 2 občanského zákoníku.
9. OCHRANA OSOBNÍCH ÚDAJŮ
9.1. Ochrana osobních údajů kupujícího, který je fyzickou osobou, je poskytována zákonem č. 101/2000 Sb., o ochraně osobních údajů, ve znění pozdějších předpisů.
9.2. Kupující souhlasí se zpracováním těchto svých osobních údajů: jméno a příjmení, adresa bydliště, identifikační číslo, daňové identifikační číslo, adresa elektronické pošty, telefonní číslo a nick (dále společně vše jen jako „osobní údaje“).
9.3. Kupující souhlasí se zpracováním osobních údajů prodávajícím, a to pro účely realizace práv a povinností z kupní smlouvy a pro účely vedení uživatelského účtu. Nezvolí-li kupující jinou možnost, souhlasí se zpracováním osobních údajů prodávajícím také pro účely zasílání informací a obchodních sdělení kupujícímu. Souhlas se zpracováním osobních údajů v celém rozsahu dle tohoto článku není podmínkou, která by sama o sobě znemožňovala uzavření kupní smlouvy.
9.4. Kupující bere na vědomí, že je povinen své osobní údaje (při registraci, ve svém uživatelském účtu, při objednávce provedené z webového rozhraní obchodu) uvádět správně a pravdivě a že je povinen bez zbytečného odkladu informovat prodávajícího o změně ve svých osobních údajích.
9.5. Zpracováním osobních údajů kupujícího může prodávající pověřit třetí osobu, jakožto zpracovatele. Kromě osob dopravujících zboží nebudou osobní údaje prodávajícím nikdy předávány třetím osobám.
9.6. Osobní údaje budou zpracovávány po dobu neurčitou. Osobní údaje budou zpracovávány v elektronické podobě automatizovaným způsobem nebo v tištěné podobě neautomatizovaným způsobem.
9.7. Kupující potvrzuje, že poskytnuté osobní údaje jsou přesné a že byl poučen o tom, že se jedná o dobrovolné poskytnutí osobních údajů.
9.8. V případě, že by se kupující domníval, že prodávající nebo zpracovatel (čl. 9.5) provádí zpracování jeho osobních údajů, které je v rozporu s ochranou soukromého a osobního života kupujícího nebo v rozporu se zákonem, zejména jsou-li osobní údaje nepřesné s ohledem na účel jejich zpracování, může:
9.8.1. požádat prodávajícího nebo zpracovatele o vysvětlení,
9.8.2. požadovat, aby prodávající nebo zpracovatel odstranil takto vzniklý stav.
9.9. Požádá-li kupující o informaci o zpracování svých osobních údajů, je mu prodávající povinen tuto informaci předat. Prodávající má právo za poskytnutí informace podle předchozí věty požadovat přiměřenou úhradu nepřevyšující náklady nezbytné na poskytnutí informace.
9.10. Svůj souhlas se zpracováním osobních údajů může zákazník kdykoliv odvolat, stejně může kdykoliv zrušit zasílání reklamních emailů, ke kterým již jednou dal souhlas.
10. ZASÍLÁNÍ OBCHODNÍCH SDĚLENÍ A UKLÁDÁNÍ COOKIES
10.1. Kupující souhlasí se zasíláním informací souvisejících se zbožím, službami nebo podnikem prodávajícího na elektronickou adresu kupujícího a dále souhlasí se zasíláním obchodních sdělení prodávajícím na elektronickou adresu kupujícího. Tento souhlas může kdykoliv odvolat.
10.2. Kupující souhlasí s ukládáním tzv. cookies na jeho počítač. V případě, že je nákup na webové stránce možné provést a závazky prodávajícího z kupní smlouvy plnit, aniž by docházelo k ukládání tzv. cookies na počítač kupujícího, může kupující souhlas podle předchozí věty kdykoliv odvolat.
11. DORUČOVÁNÍ
11.1. Oznámení týkající se vztahů prodávajícího a kupujícího, zejména týkající odstoupení od kupní smlouvy, musí být doručena poštou formou doporučeného dopisu, není-li v kupní smlouvě stanoveno jinak. Oznámení se doručují na příslušnou kontaktní adresu druhé strany a považují se za doručené a účinné okamžikem jejich dodání prostřednictvím pošty, s výjimkou oznámení o odstoupení od smlouvy učiněného kupujícím, kdy je odstoupení účinné, pokud je oznámení kupujícím ve lhůtě pro odstoupení odesláno.
11.2. Za doručené se považuje i oznámení, jehož převzetí bylo adresátem odmítnuto, které nebylo vyzvednuto v úložní době, nebo které se vrátilo jako nedoručitelné.
11.3. Smluvní strany můžou běžnou korespondenci vzájemně doručovat prostřednictvím elektronické pošty, a to na adresu elektronické pošty uvedenou v uživatelském účtu kupujícího či uvedenou kupujícím v objednávce, resp. na adresu uvedenou na webové stránce prodávajícího.
12. ZÁVĚREČNÁ USTANOVENÍ
12.1. Pokud vztah založený kupní smlouvou obsahuje mezinárodní (zahraniční) prvek, pak strany sjednávají, že vztah se řídí českým právem. Tímto nejsou dotčena práva spotřebitele vyplývající z obecně závazných právních předpisů.
12.2. Je-li některé ustanovení obchodních podmínek neplatné nebo neúčinné, nebo se takovým stane, namísto neplatných ustanovení nastoupí ustanovení, jehož smysl se neplatnému ustanovení co nejvíce přibližuje. Neplatností nebo neúčinností jednoho ustanovení není dotknutá platnost ostatních ustanovení. Změny a doplňky kupní smlouvy či obchodních podmínek vyžadují písemnou formu.
12.3. Kupní smlouva včetně obchodních podmínek je archivována prodávajícím v elektronické podobě a není přístupná.
12.4. Přílohu obchodních podmínek tvoří vzorový formulář pro odstoupení od kupní smlouvy.

1. INTRODUCTORY PROVISIONS
1.1. These terms and conditions (hereinafter referred to as the “Terms and Conditions”) of the trading company La Candela s.r.o., with registered office at Melantrichova 18, 110 00 Prague 1, identification number: 26146487, registered in the commercial register maintained by the Municipal Court in Prague, (hereinafter referred to as the “Seller”) govern in accordance with the provisions of § 1751 paragraph 1 of Act No. 89/2012 Coll., Civil Code (hereinafter referred to as the “Civil Code”) mutual rights and obligations of the contracting parties arising in connection with or on the basis of the purchase contract (hereinafter referred to as the “purchase contract”) concluded between the seller and another natural person (hereinafter referred to as the “buyer”) through the seller’s online store. The online store is operated by the seller on the website located at shosexmachinesmuseum.com (hereinafter referred to as the “website”), through the website interface (hereinafter referred to as the “store web interface”).
1.2. The terms and conditions do not apply to cases where the person who intends to purchase goods from the seller is a legal entity or a person who, when ordering goods, acts as part of his business activity or as part of his independent profession.
1.3. Provisions deviating from the terms and conditions can be negotiated in the purchase contract. Deviating provisions in the purchase contract take precedence over the provisions of the terms and conditions.
1.4. The terms and conditions are an integral part of the purchase contract. The purchase contract and terms and conditions are drawn up in the Czech language. The purchase contract can be concluded in the Czech language.
1.5. The wording of the terms and conditions may be changed or supplemented by the seller. This provision does not affect the rights and obligations arising during the effective period of the previous version of the terms and conditions.
2. USER ACCOUNT
2.1. On the website of the e-shop operator, spol. La Candela s.r.o. no mandatory registration is required for the purchase, the data entered is always and only used for the processing of the order itself and is never passed on to third parties, with the exception of the operator of postal/transport services.
3. CONCLUSION OF THE PURCHASE AGREEMENT
3.1. All the presentation of goods placed in the web interface of the store is of an informative nature and the seller is not obliged to conclude a purchase contract regarding these goods. The provisions of Section 1732, paragraph 2 of the Civil Code shall not apply.
3.2. The store’s web interface contains information about goods, including the prices of individual goods. The prices of goods are listed including value added tax and all related charges excluding postage. The prices of goods remain valid for the time they are displayed in the web interface of the store. This provision does not limit the seller’s ability to conclude a purchase contract under individually agreed conditions.
3.3. The store’s web interface also contains information on costs associated with packaging and delivery of goods to the countries listed, including the Czech Republic, Slovak Republic, EU and non-EU countries.
3.4. To order goods, the buyer fills out the order form in the web interface of the store. The order form mainly contains information about:
3.4.1. ordered goods (the ordered goods are “put” by the buyer into the electronic shopping cart of the store’s web interface),
3.4.2. method of payment of the purchase price of the goods, information on the required method of delivery of the ordered goods and
3.4.3. information about the costs associated with the delivery of the goods (hereinafter collectively referred to as the “order”).
3.5. Before sending the order to the seller, the buyer is allowed to check and change the data that the buyer entered in the order, also taking into account the possibility of the buyer to detect and correct errors that occurred when entering data into the order. The buyer sends the order to the seller by clicking the “Confirm Order” button. The information given in the order is considered correct by the seller and the order is always considered binding.
3.6. Sending an order is considered to be an act of the buyer that unambiguously identifies the ordered goods, the purchase price, the person of the buyer, the method of payment of the purchase price, and is a binding draft of the purchase contract for the contracting parties. The condition for the validity of the order is the filling in of all mandatory data in the order form, familiarization with these terms and conditions on the website and confirmation by the buyer that he has become familiar with these terms and conditions.
3.7. Immediately after receiving the order, the seller will confirm this receipt to the buyer by e-mail, to the buyer’s e-mail address specified in the user interface or in the order (hereinafter referred to as the “buyer’s e-mail address”).
3.8. The seller is always entitled depending on the nature of the order (amount of
of God, amount of the purchase price, estimated shipping costs) to ask the buyer for additional confirmation of the order (for example, in writing or by phone).
3.9. The draft purchase contract in the form of an order is valid for fifteen days.
3.10. The contractual relationship between the seller and the buyer is established by the delivery of the acceptance of the order (acceptance), which is sent by the seller to the buyer by e-mail, to the e-mail address of the buyer.
3.11. In the event that the seller cannot fulfill any of the requirements stated in the order, he will send the buyer to the buyer’s e-mail address an amended offer indicating possible variants of the order and request the buyer’s opinion.
3.12. The amended offer is considered a new draft of the purchase contract, and the purchase contract is concluded in such a case only upon acceptance by the buyer via e-mail.
3.13. The buyer agrees to use remote means of communication when concluding the purchase contract. The costs incurred by the buyer when using means of communication at a distance in connection with the conclusion of the purchase contract (costs of Internet connection, costs of telephone calls) are paid by the buyer himself, and these costs do not differ from the basic rate.
4. PRICE OF GOODS AND TERMS OF PAYMENT
4.1. The buyer can pay the price of the goods and any costs associated with the delivery of the goods according to the purchase contract to the seller in the following ways:
by credit card.
4.2. Along with the purchase price, the buyer is also obliged to pay the seller the costs associated with the packaging and delivery of the goods in the agreed amount. Unless expressly stated otherwise, the purchase price also includes the costs associated with the delivery of the goods.
4.3. The seller does not require a deposit or other similar payment from the buyer. This does not affect the provisions of Article 4.6 of the Terms and Conditions regarding the obligation to pay the purchase price of the goods in advance.
4.4. The seller is entitled, especially if the buyer does not provide additional confirmation of the order (Article 3.8), to demand payment of the entire purchase price before sending the goods to the buyer. The provisions of Section 2119, paragraph 1 of the Civil Code shall not apply.
4.5. Any discounts on the price of goods provided by the seller to the buyer cannot be combined with each other.
4.6. If it is customary in business dealings or if it is stipulated by generally binding legal regulations, the seller will issue a tax document – an invoice – to the buyer regarding payments made on the basis of the purchase contract. The seller is the payer of value added tax. Tax document – the seller issues an invoice to the buyer after payment of the price of the goods and sends it in electronic form to the buyer’s e-mail address and attaches a copy to the ordered goods.
5. WITHDRAWAL FROM THE PURCHASE AGREEMENT
5.1. The buyer acknowledges that according to the provisions of § 1837 of the Civil Code, it is not possible to withdraw from the purchase contract for the delivery of goods that have been modified according to the wishes of the buyer or for his person
5.2. If this is not the case mentioned or another case where it is not possible to withdraw from the purchase contract, the buyer has the right to withdraw from the purchase contract in accordance with § 1829, paragraph 1 of the Civil Code, within fourteen (14) days of receiving the goods , while in the event that the subject of the purchase contract is several types of goods or the delivery of several parts, this period runs from the date of acceptance of the last delivery of goods. Withdrawal from the purchase contract must be sent to the seller within the period specified in the previous sentence.
5.3. To withdraw from the purchase contract, the buyer can use the sample form provided by the seller, which forms an appendix to the terms and conditions. Withdrawal from the purchase contract can be sent by the buyer to the address of the seller’s place of business or registered office. The provisions of Article 11 of these terms and conditions apply to the delivery of withdrawal from the contract. The entrepreneur shall confirm its acceptance to the consumer in text form without undue delay.
5.4. In case of withdrawal from the purchase contract according to Article 5.2 of the terms and conditions, the purchase contract is canceled from the beginning. The goods must be returned to the seller within fourteen (14) days of withdrawal from the contract to the seller. If the buyer withdraws from the purchase contract, the buyer bears the costs associated with returning the goods to the seller, even if the goods cannot be returned by the usual postal route due to their nature.
5.5. In the case of withdrawal from the contract according to Article 5.2 of the terms and conditions, the seller will return the funds received from the buyer within fourteen (14) days of withdrawal from the purchase contract by the buyer, in the same way as the seller received them from the buyer. The seller is also entitled to return the performance provided by the buyer when the goods are returned by the buyer or in another way, if the buyer agrees and no additional costs are incurred by the buyer. If the buyer withdraws from the purchase contract, the seller is not obliged to return the received funds to the buyer before the buyer returns the goods to him or proves that he has sent the goods to the seller.
5.6. The seller is entitled to unilaterally offset the claim for payment of damage caused to the goods against the buyer’s claim for a refund of the purchase price.
5.7. Until the buyer takes over the goods, the seller is entitled to withdraw from the purchase contract at any time
t. In such a case, the seller will return the purchase price to the buyer without undue delay, without cash to the account specified by the buyer.
5.8. If a gift is provided to the buyer together with the goods, the gift contract between the seller and the buyer is concluded with the severance condition that if the buyer withdraws from the purchase contract, the gift contract regarding such a gift ceases to be effective and the buyer is obliged to return the goods to the seller together with gift given.
6. CARRIAGE AND DELIVERY OF GOODS
6.1. We ship the goods no later than 5 working days after receiving the order.
6.2. In the event that the mode of transport is contracted on the basis of a special request of the buyer, the buyer bears the risk and any additional costs associated with this mode of transport.
6.3. If, according to the purchase contract, the seller is obliged to deliver the goods to the place specified by the buyer in the order, the buyer is obliged to take over the goods upon delivery.
6.4. If, for reasons on the part of the buyer, it is necessary to deliver the goods repeatedly or in a different way than was specified in the order, the buyer is obliged to pay the costs associated with repeated delivery of the goods, or costs associated with another delivery method.
6.5. When taking over the goods from the transporter, the buyer is obliged to check the integrity of the packaging of the goods and, in the event of any defects, to notify the transporter immediately. In the event of a violation of the packaging indicating an unauthorized intrusion into the shipment, the buyer does not have to accept the shipment from the carrier.
7. RIGHTS FROM DEFECTIVE PERFORMANCE
7.1. The rights and obligations of the contracting parties regarding rights from defective performance are governed by the relevant generally binding regulations (especially the provisions of Sections 1914 to 1925, Sections 2099 to 2117 and Sections 2161 to 2174 of the Civil Code).
7.2. The seller is responsible to the buyer that the goods are free of defects upon receipt. In particular, the seller is responsible to the buyer that at the time the buyer took over the goods:
7.2.1. the goods have the properties agreed upon by the parties and, in the absence of an agreement, they have the properties that the seller or manufacturer has described or that the buyer expected with regard to the nature of the goods and on the basis of the advertising carried out by them,
7.2.2. the goods are suitable for the purpose that the seller states for their use or for which goods of this type are usually used,
7.2.3. the quality or design of the goods corresponds to the contracted sample or model, if the quality or design was determined according to the contracted sample or model,
7.2.4. is the goods in the corresponding quantity, measure or weight and
7.2.5. the goods comply with the requirements of legal regulations.
7.3. The provisions set out in Article 7.2 of the terms and conditions do not apply to goods sold at a lower price to a defect for which a lower price was agreed, to wear and tear of the goods caused by its usual use, in the case of used goods to a defect corresponding to the degree of use or wear that the goods had at the time of receipt by the buyer, or if it follows from the nature of the goods.
7.4. If a defect becomes apparent within six months of receipt, it is considered that the goods were already defective upon receipt.
7.5. Rights from defective performance are exercised by the buyer at the address of the seller’s place of business, where the acceptance of the complaint is possible with regard to the range of goods sold, possibly also at the registered office or place of business. The moment when the seller receives the claimed goods from the buyer is considered to be the moment of application of the complaint.
7.6. Additional rights and obligations of the parties related to the seller’s liability for defects may be regulated by the seller’s complaint procedure.
8. OTHER RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTIES
8.1. The buyer acquires ownership of the goods by paying the full purchase price of the goods
8.2. In relation to the buyer, the seller is not bound by any codes of conduct in the sense of the provisions of § 1826 paragraph 1 letter e) of the Civil Code.
8.3. The out-of-court settlement of consumer disputes arising from the purchase contract is the responsibility of the Czech Trade Inspection, with registered office at Štěpánská 567/15, 120 00 Prague 2, ID number: 000 20 869, internet address: http://www.coi.cz
8.4. The seller is authorized to sell goods on the basis of a trade license. The trade inspection is carried out by the relevant trade office within its jurisdiction. The Office for Personal Data Protection supervises the area of personal data protection. The Czech Trade Inspection, to a defined extent, supervises, among other things, compliance with Act No. 634/1992 Coll., on consumer protection, as amended.
8.5. The buyer hereby assumes the risk of a change in circumstances within the meaning of § 1765, paragraph 2 of the Civil Code.
9. PROTECTION OF PERSONAL DATA
9.1. The protection of personal data of the buyer, who is a natural person, is provided by Act No. 101/2000 Coll., on the protection of personal data, as amended.
9.2. The buyer agrees to the processing of his personal data: first and last name, residential address, identification number, tax identification number, e-mail address, telephone number and nickname (hereafter referred to as “personal data”).
9.3. The buyer agrees to the processing of personal data by the seller, for the purposes of realizing rights and obligations from the purchase contract and for the purposes of maintaining a user account. If the buyer does not choose another option, he agrees to personal processing
ch data by the seller also for the purpose of sending information and business messages to the buyer. Consent to the processing of personal data in its entirety according to this article is not a condition that would in itself make it impossible to conclude a purchase contract.
9.4. The buyer acknowledges that he is obliged to provide his personal data correctly and truthfully (when registering, in his user account, when ordering from the store’s web interface) and that he is obliged to inform the seller without undue delay of a change in his personal data.
9.5. The seller can entrust the processing of the buyer’s personal data to a third party as a processor. Apart from the persons transporting the goods, personal data will never be passed on to third parties by the seller.
9.6. Personal data will be processed indefinitely. Personal data will be processed in electronic form in an automated manner or in printed form in a non-automated manner.
9.7. The buyer confirms that the personal data provided is accurate and that he has been informed that this is a voluntary provision of personal data.
9.8. In the event that the buyer believes that the seller or the processor (Article 9.5) is processing his personal data in violation of the protection of the buyer’s private and personal life or in violation of the law, especially if the personal data is inaccurate with regard to for the purpose of their processing, may:
9.8.1. ask the seller or processor for an explanation,
9.8.2. require the seller or the processor to remove the condition thus created.
9.9. If the buyer requests information about the processing of his personal data, the seller is obliged to provide him with this information. The seller has the right to request a reasonable payment not exceeding the costs necessary to provide the information for the provision of information according to the previous sentence.
9.10. The customer can withdraw his consent to the processing of personal data at any time, as well as cancel the sending of advertising emails to which he has already given consent at any time.
10. SENDING COMMERCIAL MESSAGES AND STORING COOKIES
10.1. The buyer agrees to send information related to the seller’s goods, services or business to the buyer’s e-mail address and further agrees to the seller’s sending commercial messages to the buyer’s e-mail address. He can revoke this consent at any time.
10.2. The buyer agrees to the storage of so-called cookies on his computer. In the event that it is possible to make a purchase on the website and to fulfill the seller’s obligations from the purchase contract without so-called cookies being stored on the buyer’s computer, the buyer can revoke the consent according to the previous sentence at any time.
11. DELIVERY
11.1. Notifications regarding the relationship between the seller and the buyer, in particular regarding withdrawal from the purchase contract, must be delivered by registered mail, unless otherwise stipulated in the purchase contract. Notices shall be delivered to the relevant contact address of the other party and shall be deemed to have been delivered and effective upon delivery by post, except for notice of withdrawal by the Buyer, in which case the withdrawal is effective if the notice is sent by the Buyer within the withdrawal period.
11.2. Notices whose acceptance was refused by the addressee, which were not picked up within the storage period, or which were returned as undeliverable are also considered delivered.
11.3. The contracting parties may deliver regular correspondence to each other via e-mail, to the e-mail address specified in the buyer’s user account or specified by the buyer in the order, or to the address listed on the seller’s website.
12. FINAL PROVISIONS
12.1. If the relationship established by the purchase contract contains an international (foreign) element, then the parties agree that the relationship is governed by Czech law. This does not affect consumer rights arising from generally binding legal regulations.
12.2. If any provision of the terms and conditions is invalid or ineffective, or becomes so, the invalid provision will be replaced by a provision whose meaning is as close as possible to the invalid provision. The invalidity or ineffectiveness of one provision does not affect the validity of the other provisions. Changes and additions to the purchase contract or terms and conditions require written form.
12.3. The purchase contract, including the terms and conditions, is archived by the seller in electronic form and is not accessible.
12.4. The annex to the terms and conditions consists of a sample form for withdrawing from the purchase contract.

1. EINFÜHRENDE BESTIMMUNGEN
1.1. Diese Geschäftsbedingungen (im Folgenden „Geschäftsbedingungen“ genannt) der Handelsgesellschaft La Candela s.r.o. mit Sitz in Melantrichova 18, 110 00 Prag 1, Identifikationsnummer: 26146487, eingetragen im Handelsregister der Stadt Gericht in Prag, (im Folgenden „Verkäufer“ genannt) regeln gemäß den Bestimmungen des § 1751 Abs. 1 des Gesetzes Nr. 89/2012 Slg., Bürgerliches Gesetzbuch (im Folgenden „Bürgerliches Gesetzbuch“) gegenseitige Rechte und Pflichten der Vertragsparteien, die sich im Zusammenhang mit oder aufgrund des zwischen dem Verkäufer und einer anderen natürlichen Person (nachfolgend „Käufer“) über den Verkäufer abgeschlossenen Kaufvertrages (nachfolgend „Kaufvertrag“ genannt) ergeben Online-Shop. Der Online-Shop wird vom Verkäufer auf der Website unter shosexmachinesmuseum.com (im Folgenden als „Website“ bezeichnet) über die Website-Schnittstelle (im Folgenden als „Shop-Webschnittstelle“ bezeichnet) betrieben.
1.2. Die Geschäftsbedingungen gelten nicht für den Fall, dass die Person, die beim Verkäufer Waren kaufen will, eine juristische Person oder eine Person ist, die bei der Warenbestellung in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.
1.3. Im Kaufvertrag können von den AGB abweichende Regelungen ausgehandelt werden. Abweichende Regelungen im Kaufvertrag gehen den Regelungen der AGB vor.
1.4. Die AGB sind Bestandteil des Kaufvertrages. Der Kaufvertrag und die Geschäftsbedingungen werden in tschechischer Sprache erstellt. Der Kaufvertrag kann in tschechischer Sprache abgeschlossen werden.
1.5. Der Wortlaut der AGB kann vom Verkäufer geändert oder ergänzt werden. Diese Bestimmung berührt nicht die Rechte und Pflichten, die während der Gültigkeitsdauer der vorherigen Version der Allgemeinen Geschäftsbedingungen entstanden sind.
2. BENUTZERKONTO
2.1. Auf der Website des E-Shop-Betreibers, spol. La Candela s.r.o. Für den Kauf ist keine zwingende Registrierung erforderlich, die eingegebenen Daten werden stets nur für die Abwicklung der Bestellung selbst verwendet und niemals an Dritte weitergegeben, mit Ausnahme der Betreiber von Post-/Transportdiensten.
3. ABSCHLUSS DES KAUFVERTRAGS
3.1. Alle Warenpräsentationen auf der Webschnittstelle des Shops haben informativen Charakter und der Verkäufer ist nicht verpflichtet, einen Kaufvertrag über diese Waren abzuschließen. Die Vorschriften des § 1732 Abs. 2 BGB finden keine Anwendung.
3.2. Die Webschnittstelle des Geschäfts enthält Informationen über Waren, einschließlich der Preise einzelner Waren. Die Warenpreise sind inklusive Mehrwertsteuer und aller damit zusammenhängenden Abgaben exklusive Porto aufgeführt. Die Warenpreise bleiben für die Zeit gültig, in der sie auf der Webschnittstelle des Geschäfts angezeigt werden. Diese Bestimmung schränkt die Möglichkeit des Verkäufers, einen Kaufvertrag zu individuell vereinbarten Bedingungen abzuschließen, nicht ein.
3.3. Die Webschnittstelle des Shops enthält auch Informationen über Kosten im Zusammenhang mit der Verpackung und Lieferung von Waren in die aufgeführten Länder, einschließlich der Tschechischen Republik, der Slowakischen Republik, der EU und der Nicht-EU-Länder.
3.4. Um Waren zu bestellen, füllt der Käufer das Bestellformular in der Webschnittstelle des Geschäfts aus. Das Bestellformular enthält hauptsächlich Informationen über:
3.4.1. bestellte Ware (die bestellte Ware wird vom Käufer in den elektronischen Warenkorb der Webschnittstelle des Geschäfts “gelegt”,
3.4.2. Zahlungsart des Kaufpreises der Ware, Angaben zur gewünschten Versandart der bestellten Ware und
3.4.3. Informationen über die mit der Lieferung der Ware verbundenen Kosten (nachfolgend zusammenfassend „Bestellung“ genannt).
3.5. Vor dem Absenden der Bestellung an den Verkäufer ist der Käufer berechtigt, die Daten, die der Käufer in die Bestellung eingegeben hat, zu überprüfen und zu ändern, wobei auch die Möglichkeit des Käufers berücksichtigt wird, Fehler zu erkennen und zu korrigieren, die bei der Eingabe der Daten in die Bestellung aufgetreten sind. Der Käufer sendet die Bestellung an den Verkäufer, indem er auf die Schaltfläche „Bestellung bestätigen“ klickt. Die in der Bestellung gemachten Angaben werden vom Verkäufer als richtig angesehen und die Bestellung gilt stets als verbindlich.
3.6. Das Absenden einer Bestellung gilt als Handlung des Käufers, die die bestellte Ware, den Kaufpreis, die Person des Käufers, die Zahlungsweise des Kaufpreises eindeutig identifiziert und einen für den Vertragsabschluss verbindlichen Entwurf des Kaufvertrages darstellt Parteien. Die Bedingung für die Gültigkeit der Bestellung ist das Ausfüllen aller obligatorischen Daten im Bestellformular, die Kenntnisnahme dieser Allgemeinen Geschäftsbedingungen auf der Website und die Bestätigung des Käufers, dass er sich mit diesen Allgemeinen Geschäftsbedingungen vertraut gemacht hat.
3.7. Unmittelbar nach Eingang der Bestellung bestätigt der Verkäufer dem Käufer diesen Eingang per E-Mail an die in der Benutzeroberfläche oder in der Bestellung angegebene E-Mail-Adresse des Käufers (nachfolgend „E-Mail-Adresse des Käufers“ genannt). .
3.8. Der Verkäufer ist immer berechtigt, je nach Art der Bestellung (Höhe von
Höhe des Kaufpreises, voraussichtliche Versandkosten) vom Käufer eine zusätzliche Auftragsbestätigung (z. B. schriftlich oder telefonisch) zu verlangen.
3.9. Der Kaufvertragsentwurf in Form einer Bestellung ist fünfzehn Tage gültig.
3.10. Das Vertragsverhältnis zwischen dem Verkäufer und dem Käufer kommt durch die Zustellung der vom Verkäufer an den Käufer per E-Mail versandten Bestellbestätigung (Annahme) an die E-Mail-Adresse des Käufers zustande.
3.11. Für den Fall, dass der Verkäufer eine der in der Bestellung genannten Anforderungen nicht erfüllen kann, wird er dem Käufer an die E-Mail-Adresse des Käufers ein geändertes Angebot mit möglichen Varianten der Bestellung senden und den Käufer um seine Meinung bitten.
3.12. Das geänderte Angebot gilt als neuer Entwurf des Kaufvertrags und der Kaufvertrag kommt in diesem Fall erst durch die Annahme durch den Käufer per E-Mail zustande.
3.13. Der Käufer verpflichtet sich, beim Abschluss des Kaufvertrags Fernkommunikationsmittel zu verwenden. Die Kosten, die dem Käufer bei der Nutzung von Fernkommunikationsmitteln im Zusammenhang mit dem Abschluss des Kaufvertrags entstehen (Kosten für die Internetverbindung, Kosten für Telefonanrufe), trägt der Käufer selbst und diese Kosten unterscheiden sich nicht von den Grundkosten Bewertung.
4. WARENPREIS UND ZAHLUNGSBEDINGUNGEN
4.1. Der Käufer kann den Preis der Ware und etwaige mit der Lieferung der Ware verbundene Kosten gemäß dem Kaufvertrag an den Verkäufer auf folgende Weise bezahlen:
mit Kreditkarte.
4.2. Der Käufer ist verpflichtet, dem Verkäufer neben dem Kaufpreis auch die mit der Verpackung und Zustellung der Ware verbundenen Kosten in vereinbarter Höhe zu zahlen. Sofern nicht ausdrücklich anders angegeben, beinhaltet der Kaufpreis auch die mit der Lieferung der Ware verbundenen Kosten.
4.3. Der Verkäufer verlangt vom Käufer keine Anzahlung oder ähnliche Zahlung. Die Bestimmungen in Artikel 4.6 der AGB über die Verpflichtung zur Vorauszahlung des Kaufpreises der Ware bleiben hiervon unberührt.
4.4. Der Verkäufer ist berechtigt, insbesondere wenn der Käufer keine zusätzliche Auftragsbestätigung (Ziffer 3.8) abgibt, die Zahlung des gesamten Kaufpreises vor Versendung der Ware an den Käufer zu verlangen. Die Vorschriften des § 2119 Abs. 1 BGB finden keine Anwendung.
4.5. Etwaige Rabatte auf den Warenpreis, die der Verkäufer dem Käufer gewährt, sind nicht miteinander kombinierbar.
4.6. Soweit im Geschäftsverkehr üblich oder durch allgemein verbindliche Rechtsvorschriften vorgeschrieben, stellt der Verkäufer dem Käufer über die aufgrund des Kaufvertrages geleisteten Zahlungen einen Steuerbeleg – eine Rechnung – aus. Zahler der Mehrwertsteuer ist der Verkäufer. Steuerdokument – Der Verkäufer stellt dem Käufer nach Zahlung des Warenpreises eine Rechnung aus und sendet diese in elektronischer Form an die E-Mail-Adresse des Käufers und fügt der bestellten Ware eine Kopie bei.
5. RÜCKTRITT VOM KAUFVERTRAG
5.1. Der Käufer nimmt zur Kenntnis, dass gemäß den Bestimmungen des § 1837 BGB ein Rücktritt vom Kaufvertrag bei Lieferung von Waren, die nach den Wünschen des Käufers oder für seine Person verändert wurden, nicht möglich ist
5.2. Ist dies nicht der Fall oder ein sonstiger Fall, in dem ein Rücktritt vom Kaufvertrag nicht möglich ist, hat der Käufer das Recht, gemäß § 1829 Abs. 1 BGB innerhalb von vierzehn (14 ) Tage nach Erhalt der Ware, wobei im Falle, dass Gegenstand des Kaufvertrages mehrere Warenarten oder die Lieferung mehrerer Teile sind, diese Frist ab dem Datum der Annahme der letzten Warenlieferung läuft. Der Rücktritt vom Kaufvertrag muss innerhalb der im vorstehenden Satz genannten Frist an den Verkäufer gesendet werden.
5.3. Für den Rücktritt vom Kaufvertrag kann der Käufer das vom Verkäufer zur Verfügung gestellte Musterformular verwenden, das eine Anlage zu den AGB bildet. Der Rücktritt vom Kaufvertrag kann vom Käufer an die Adresse des Geschäfts- oder Sitzes des Verkäufers gesendet werden. Für den Rücktritt vom Vertrag gelten die Bestimmungen des Artikels 11 dieser AGB. Der Unternehmer wird die Annahme gegenüber dem Verbraucher unverzüglich in Textform bestätigen.
5.4. Im Falle des Rücktritts vom Kaufvertrag gemäß Artikel 5.2 der AGB wird der Kaufvertrag von Anfang an aufgehoben. Die Ware ist innerhalb von vierzehn (14) Tagen nach Rücktritt vom Vertrag an den Verkäufer zurückzusenden. Tritt der Käufer vom Kaufvertrag zurück, trägt der Käufer die mit der Rücksendung der Ware an den Verkäufer verbundenen Kosten, auch wenn die Ware aufgrund ihrer Beschaffenheit nicht auf dem üblichen Postweg zurückgesandt werden kann.
5.5. Im Falle des Rücktritts vom Vertrag gemäß Artikel 5.2 der Allgemeinen Geschäftsbedingungen erstattet der Verkäufer die vom Käufer erhaltenen Gelder innerhalb von vierzehn (14) Tagen nach Rücktritt vom Kaufvertrag durch den Käufer auf die gleiche Weise wie die Verkäufer hat sie vom Käufer erhalten. Der Verkäufer ist auch berechtigt, die vom Käufer erbrachte Leistung bei Rückgabe der Ware durch den Käufer oder auf andere Weise zurückzugeben, wenn der Käufer damit einverstanden ist und dem Käufer keine zusätzlichen Kosten entstehen. Wenn der Käufer vom Kaufvertrag zurücktritt, ist der Verkäufer nicht verpflichtet, das erhaltene Geld an den Käufer zurückzugeben, bevor der Käufer die Ware an ihn zurücksendet oder nachweist, dass er die Ware an den Verkäufer gesendet hat.
5.6. Der Verkäufer ist berechtigt, den Anspruch auf Zahlung des an der Ware verursachten Schadens einseitig mit dem Anspruch des Käufers auf Rückerstattung des Kaufpreises aufzurechnen.
5.7. Bis zur Übernahme der Ware durch den Käufer ist der Verkäufer berechtigt, jederzeit vom Kaufvertrag zurückzutreten
t. In einem solchen Fall wird der Verkäufer dem Käufer den Kaufpreis unverzüglich bargeldlos auf das vom Käufer angegebene Konto zurückerstatten.
5.8. Wird dem Käufer zusammen mit der Ware ein Geschenk überreicht, kommt der Geschenkvertrag zwischen dem Verkäufer und dem Käufer mit der Aufhebungsbedingung zustande, dass bei Rücktritt des Käufers vom Kaufvertrag der Geschenkvertrag über ein solches Geschenk hinfällig wird und Der Käufer ist verpflichtet, die Ware zusammen mit dem Geschenk an den Verkäufer zurückzugeben.
6. BEFÖRDERUNG UND LIEFERUNG DER WAREN
6.1. Wir versenden die Ware spätestens 5 Werktage nach Bestelleingang.
6.2. Wird die Transportart auf besonderen Wunsch des Käufers beauftragt, trägt der Käufer das Risiko und alle mit dieser Transportart verbundenen Mehrkosten.
6.3. Wenn der Verkäufer gemäß dem Kaufvertrag verpflichtet ist, die Ware an den vom Käufer in der Bestellung angegebenen Ort zu liefern, ist der Käufer verpflichtet, die Ware bei Lieferung zu übernehmen.
6.4. Wenn es aus Gründen des Käufers erforderlich ist, die Ware wiederholt oder auf andere Weise als in der Bestellung angegeben zu liefern, ist der Käufer verpflichtet, die mit der erneuten Lieferung der Ware verbundenen Kosten zu tragen, oder Kosten, die mit einer anderen Liefermethode verbunden sind.
6.5. Bei Übernahme der Ware vom Transporteur ist der Käufer verpflichtet, die Unversehrtheit der Verpackung der Ware zu prüfen und etwaige Mängel unverzüglich dem Transporteur zu melden. Im Falle einer Verletzung der Verpackung, die auf einen unbefugten Eingriff in die Sendung hindeutet, muss der Käufer die Sendung nicht vom Spediteur annehmen.
7. RECHTE AUS FEHLERHAFTER LEISTUNG
7.1. Die Rechte und Pflichten der Vertragsparteien bei Mängelrechten richten sich nach den einschlägigen allgemein verbindlichen Vorschriften (insbesondere den Vorschriften der §§ 1914 bis 1925, §§ 2099 bis 2117 und §§ 2161 bis 2174 BGB).
7.2. Der Verkäufer haftet gegenüber dem Käufer dafür, dass die Ware bei Erhalt mangelfrei ist. Insbesondere haftet der Verkäufer dem Käufer dafür, dass zum Zeitpunkt der Warenübernahme durch den Käufer:
7.2.1. die Ware die von den Parteien vereinbarten Eigenschaften hat und mangels einer Vereinbarung die Eigenschaften hat, die der Verkäufer oder Hersteller beschrieben hat oder die der Käufer aufgrund der Beschaffenheit der Ware und aufgrund der Werbung erwartet hat von ihnen durchgeführt,
7.2.2. die Ware für den Zweck geeignet ist, den der Verkäufer für ihre Verwendung angibt oder für den Waren dieser Art üblicherweise verwendet werden,
7.2.3. die Qualität oder Ausführung der Ware dem vertraglich vereinbarten Muster oder Modell entspricht, wenn die Qualität oder Ausführung nach dem vertraglich vereinbarten Muster oder Modell bestimmt wurde,
7.2.4. ist die Ware in der entsprechenden Menge, Maß oder Gewicht und
7.2.5. die Ware den Anforderungen der gesetzlichen Vorschriften entspricht.
7.3. Die Bestimmungen in Artikel 7.2 der Allgemeinen Geschäftsbedingungen gelten nicht für Waren, die zu einem niedrigeren Preis verkauft wurden, für einen Mangel, für den ein niedrigerer Preis vereinbart wurde, für eine durch die übliche Verwendung verursachte Abnutzung der Ware, im Falle von Gebrauchte Ware mit einem Mangel, der dem Gebrauchs- oder Abnutzungsgrad entspricht, den die Ware zum Zeitpunkt der Übernahme durch den Käufer hatte, oder wenn er sich aus der Beschaffenheit der Ware ergibt.
7.4. Zeigt sich innerhalb von sechs Monaten nach Erhalt ein Mangel, so gilt die Ware bereits bei Erhalt als mangelhaft.
7.5. Rechte aus Leistungsmängeln werden vom Käufer unter der Anschrift des Geschäftssitzes des Verkäufers geltend gemacht, wo die Annahme der Reklamation hinsichtlich des verkauften Warensortiments möglich ist, ggf. auch am Sitz oder Geschäftssitz. Als Zeitpunkt der Geltendmachung der Reklamation gilt der Moment, in dem der Verkäufer die reklamierte Ware vom Käufer erhält.
7.6. Weitere Rechte und Pflichten der Parteien im Zusammenhang mit der Mängelhaftung des Verkäufers können durch das Reklamationsverfahren des Verkäufers geregelt werden.
8. SONSTIGE RECHTE UND PFLICHTEN DER VERTRAGSPARTEIEN
8.1. Der Käufer erwirbt das Eigentum an der Ware durch Zahlung des vollen Kaufpreises der Ware
8.2. Der Verkäufer ist im Verhältnis zum Käufer an keine Verhaltenskodizes im Sinne der Vorschriften des § 1826 Abs. 1 lit e) des Bürgerlichen Gesetzbuches.
8.3. Für die außergerichtliche Beilegung von Verbraucherstreitigkeiten aus dem Kaufvertrag ist die Tschechische Gewerbeinspektion mit Sitz in Štěpánská 567/15, 120 00 Prag 2, ID-Nummer: 000 20 869, Internetadresse: http: //www.coi.cz
8.4. Der Verkäufer ist berechtigt, Waren aufgrund eines Gewerbescheins zu verkaufen. Die Gewerbeaufsicht wird durch das zuständige Gewerbeamt in seinem Zuständigkeitsbereich durchgeführt. Das Amt für den Schutz personenbezogener Daten überwacht den Bereich des Schutzes personenbezogener Daten. Die Tschechische Handelsinspektion überwacht in einem bestimmten Umfang unter anderem die Einhaltung des Gesetzes Nr. 634/1992 Slg. über Verbraucherschutz in der geänderten Fassung.
8.5. Der Käufer übernimmt hiermit das Risiko einer Änderung der Umstände im Sinne des § 1765 Abs. 2 BGB.
9. SCHUTZ PERSONENBEZOGENER DATEN
9.1. Der Schutz personenbezogener Daten des Käufers, der eine natürliche Person ist, wird durch das Gesetz Nr. 101/2000 Slg. über den Schutz personenbezogener Daten in der geänderten Fassung gewährleistet.
9.2. Der Käufer stimmt der Verarbeitung seiner personenbezogenen Daten zu: Vor- und Nachname, Wohnadresse, Identifikationsnummer, Steueridentifikationsnummer, E-Mail-Adresse, Telefonnummer und Spitzname (nachfolgend „personenbezogene Daten“ genannt).
9.3. Der Käufer stimmt der Verarbeitung personenbezogener Daten durch den Verkäufer zum Zweck der Verwirklichung von Rechten und Pflichten aus dem Kaufvertrag und zum Zweck der Führung eines Benutzerkontos zu. Wählt der Käufer keine andere Option, stimmt er der personenbezogenen Verarbeitung zu
ch-Daten durch den Verkäufer auch zum Zweck der Zusendung von Informationen und geschäftlichen Mitteilungen an den Käufer. Die Zustimmung zur vollständigen Verarbeitung personenbezogener Daten gemäß diesem Artikel ist keine Bedingung, die den Abschluss eines Kaufvertrags an sich unmöglich machen würde.
9.4. Der Käufer erkennt an, dass er verpflichtet ist, seine persönlichen Daten richtig und wahrheitsgemäß anzugeben (bei der Registrierung, in seinem Benutzerkonto, bei der Bestellung über die Webschnittstelle des Geschäfts) und dass er verpflichtet ist, den Verkäufer unverzüglich über eine Änderung seiner persönlichen Daten zu informieren Daten.
9.5. Der Verkäufer kann die Verarbeitung der personenbezogenen Daten des Käufers einem Dritten als Auftragsverarbeiter anvertrauen. Außer den Personen, die die Waren transportieren, werden personenbezogene Daten vom Verkäufer niemals an Dritte weitergegeben.
9.6. Personenbezogene Daten werden auf unbestimmte Zeit verarbeitet. Personenbezogene Daten werden in elektronischer Form automatisiert oder in gedruckter Form nicht automatisiert verarbeitet.
9.7. Der Käufer bestätigt, dass die angegebenen personenbezogenen Daten korrekt sind und dass er darüber informiert wurde, dass es sich um eine freiwillige Angabe personenbezogener Daten handelt.
9.8. Für den Fall, dass der Käufer der Ansicht ist, dass der Verkäufer oder der Auftragsverarbeiter (Artikel 9.5) seine personenbezogenen Daten unter Verletzung des Schutzes des Privat- und Persönlichkeitslebens des Käufers oder unter Verstoß gegen das Gesetz verarbeitet, insbesondere wenn die personenbezogenen Daten in Bezug auf unrichtig sind zum Zweck ihrer Verarbeitung:
9.8.1. den Verkäufer oder Verarbeiter um eine Erklärung bitten,
9.8.2. verlangen, dass der Verkäufer oder der Verarbeiter den so geschaffenen Zustand beseitigt.
9.9. Wenn der Käufer Auskunft über die Verarbeitung seiner personenbezogenen Daten verlangt, ist der Verkäufer verpflichtet, ihm diese Auskunft zu erteilen. Für die Auskunftserteilung nach vorstehendem Satz ist der Verkäufer berechtigt, eine angemessene Vergütung zu verlangen, die die zur Erteilung der Auskunft erforderlichen Kosten nicht übersteigt.
9.10. Der Kunde kann seine Einwilligung zur Verarbeitung personenbezogener Daten jederzeit widerrufen, sowie der Zusendung von Werbe-E-Mails, in die er bereits eingewilligt hat, jederzeit widersprechen.
10. VERSENDEN VON KOMMERZIELLEN NACHRICHTEN UND SPEICHERN VON COOKIES
10.1. Der Käufer erklärt sich damit einverstanden, Informationen über die Waren, Dienstleistungen oder das Geschäft des Verkäufers an die E-Mail-Adresse des Käufers zu senden, und stimmt ferner zu, dass der Verkäufer kommerzielle Nachrichten an die E-Mail-Adresse des Käufers sendet. Diese Einwilligung kann er jederzeit widerrufen.
10.2. Der Käufer stimmt der Speicherung sogenannter Cookies auf seinem Rechner zu. Für den Fall, dass ein Kauf auf der Website und die Erfüllung der Pflichten des Verkäufers aus dem Kaufvertrag möglich sind, ohne dass sogenannte Cookies auf dem Computer des Käufers gespeichert werden, kann der Käufer die Einwilligung gemäß dem vorstehenden Satz jederzeit widerrufen .
11. LIEFERUNG
11.1. Mitteilungen über die Beziehung zwischen dem Verkäufer und dem Käufer, insbesondere über den Rücktritt vom Kaufvertrag, müssen per Einschreiben zugestellt werden, sofern im Kaufvertrag nichts anderes bestimmt ist. Mitteilungen sind an die entsprechende Kontaktadresse der anderen Partei zuzustellen und gelten mit der Zustellung per Post als zugestellt und wirksam, mit Ausnahme der Rücktrittserklärung des Käufers, in diesem Fall ist der Rücktritt wirksam, wenn die Mitteilung per Post gesendet wird der Käufer innerhalb der Widerrufsfrist.
11.2. Als zugestellt gelten auch Mitteilungen, deren Annahme vom Empfänger verweigert wurde, die nicht innerhalb der Aufbewahrungsfrist abgeholt oder als unzustellbar zurückgesandt wurden.
11.3. Die Vertragsparteien können regelmäßige Korrespondenz per E-Mail an die im Benutzerkonto des Käufers angegebene oder vom Käufer in der Bestellung angegebene E-Mail-Adresse zustellen, oder an die auf der Website des Verkäufers angegebene Adresse.
12. SCHLUSSBESTIMMUNGEN
12.1. Wenn die durch den Kaufvertrag begründete Beziehung ein internationales (ausländisches) Element enthält, vereinbaren die Parteien, dass die Beziehung dem tschechischen Recht unterliegt. Verbraucherrechte aus allgemein verbindlichen Rechtsvorschriften bleiben hiervon unberührt.
12.2. Sollte eine Bestimmung der AGB ungültig oder unwirksam sein oder werden, wird die ungültige Bestimmung durch eine Bestimmung ersetzt, deren Bedeutung der ungültigen Bestimmung am nächsten kommt. Die Nichtigkeit oder Unwirksamkeit einer Bestimmung berührt die Gültigkeit der anderen Bestimmungen nicht. Änderungen und Ergänzungen des Kaufvertrages oder der Geschäftsbedingungen bedürfen der Schriftform.
12.3. Der Kaufvertrag einschließlich der AGB wird vom Verkäufer in elektronischer Form archiviert und ist nicht zugänglich.
12.4. Die Anlage zu den AGB besteht aus einem Musterformular für den Rücktritt vom Kaufvertrag.

1. DISPOSIZIONI INTRODUTTIVE
1.1. Questi termini e condizioni (di seguito denominati “Termini e Condizioni”) della società commerciale La Candela s.r.o., con sede legale in Melantrichova 18, 110 00 Praga 1, numero di identificazione: 26146487, iscritta nel registro delle imprese tenuto dal Comune Tribunale di Praga, (di seguito denominato il “Venditore”) disciplina in conformità alle disposizioni del § 1751 comma 1 della legge n. 89/2012 Coll., Codice Civile (di seguito denominato il “Codice Civile”) diritti reciproci e gli obblighi dei contraenti nascenti in connessione o in base al contratto di acquisto (di seguito denominato “contratto di acquisto”) concluso tra il venditore ed un’altra persona fisica (di seguito denominata “acquirente”) per il tramite del venditore negozio online. Il negozio online è gestito dal venditore sul sito web situato all’indirizzo shosexmachinesmuseum.com (di seguito denominato “sito web”), tramite l’interfaccia del sito web (di seguito denominata “interfaccia web del negozio”).
1.2. I termini e le condizioni non si applicano ai casi in cui la persona che intende acquistare la merce dal venditore sia una persona giuridica o una persona che, al momento dell’ordine della merce, agisca nell’ambito della propria attività imprenditoriale o nell’ambito della propria libera professione.
1.3. Disposizioni divergenti dai termini e dalle condizioni possono essere negoziate nel contratto di acquisto. Disposizioni divergenti nel contratto di acquisto prevalgono sulle disposizioni dei termini e delle condizioni.
1.4. I termini e le condizioni sono parte integrante del contratto di acquisto. Il contratto di acquisto e i termini e le condizioni sono redatti in lingua ceca. Il contratto di acquisto può essere concluso in lingua ceca.
1.5. La formulazione dei termini e delle condizioni può essere modificata o integrata dal venditore. Questa disposizione non pregiudica i diritti e gli obblighi derivanti durante il periodo di efficacia della versione precedente dei termini e condizioni.
2. ACCOUNT UTENTE
2.1. Sul sito web dell’operatore dell’e-shop, spol. La Candela s.r.o. per l’acquisto non è richiesta la registrazione obbligatoria, i dati inseriti sono sempre e solo utilizzati per l’evasione dell’ordine stesso e non vengono mai ceduti a terzi, ad eccezione del gestore dei servizi postali/trasporto.
3. CONCLUSIONE DEL CONTRATTO DI ACQUISTO
3.1. Tutta la presentazione della merce inserita nell’interfaccia web del negozio è di natura informativa e il venditore non è obbligato a concludere un contratto di acquisto relativo a tale merce. Non si applicano le disposizioni dell’articolo 1732, comma 2, del codice civile.
3.2. L’interfaccia web del negozio contiene informazioni sulle merci, inclusi i prezzi delle singole merci. I prezzi delle merci sono indicati comprensivi di imposta sul valore aggiunto e tutte le relative spese escluse le spese di spedizione. I prezzi delle merci restano validi per il tempo in cui vengono visualizzati nell’interfaccia web del negozio. Questa disposizione non limita la capacità del venditore di concludere un contratto di acquisto a condizioni concordate individualmente.
3.3. L’interfaccia web del negozio contiene anche informazioni sui costi associati all’imballaggio e alla consegna delle merci nei paesi elencati, tra cui Repubblica Ceca, Repubblica Slovacca, paesi UE ed extra UE.
3.4. Per ordinare la merce, l’acquirente compila il modulo d’ordine nell’interfaccia web del negozio. Il modulo d’ordine contiene principalmente informazioni su:
3.4.1. merce ordinata (la merce ordinata viene “messa” dall’acquirente nel carrello elettronico dell’interfaccia web del negozio),
3.4.2. modalità di pagamento del prezzo di acquisto della merce, informazioni sulla modalità di consegna richiesta della merce ordinata e
3.4.3. informazioni sui costi associati alla consegna della merce (di seguito collettivamente denominati “ordine”).
3.5. Prima di inviare l’ordine al venditore, l’acquirente è autorizzato a controllare e modificare i dati che l’acquirente ha inserito nell’ordine, tenendo anche conto della possibilità dell’acquirente di rilevare e correggere gli errori verificatisi durante l’inserimento dei dati nell’ordine. L’acquirente invia l’ordine al venditore facendo clic sul pulsante “Conferma ordine”. Le informazioni fornite nell’ordine sono ritenute corrette dal venditore e l’ordine è sempre considerato vincolante.
3.6. L’invio di un ordine è considerato un atto dell’acquirente che identifica inequivocabilmente la merce ordinata, il prezzo di acquisto, la persona dell’acquirente, la modalità di pagamento del prezzo di acquisto, ed è una bozza vincolante del contratto di acquisto per la contrattazione partiti. La condizione per la validità dell’ordine è la compilazione di tutti i dati obbligatori nel modulo d’ordine, la conoscenza di questi termini e condizioni sul sito Web e la conferma da parte dell’acquirente di aver preso conoscenza di questi termini e condizioni.
3.7. Immediatamente dopo aver ricevuto l’ordine, il venditore confermerà tale ricezione all’acquirente tramite e-mail, all’indirizzo e-mail dell’acquirente specificato nell’interfaccia utente o nell’ordine (di seguito denominato “indirizzo e-mail dell’acquirente”) .
3.8. Il venditore ha sempre diritto a seconda della natura dell’ordine (importo di
di Dio, importo del prezzo di acquisto, spese di spedizione stimate) per chiedere all’acquirente un’ulteriore conferma dell’ordine (ad esempio per iscritto o telefonicamente).
3.9. La bozza del contratto di acquisto sotto forma di ordine ha una validità di quindici giorni.
3.10. Il rapporto contrattuale tra il venditore e l’acquirente si instaura con la consegna dell’accettazione dell’ordine (accettazione), che viene inviata dal venditore all’acquirente tramite e-mail, all’indirizzo di posta elettronica dell’acquirente.
3.11. Nel caso in cui il venditore non possa soddisfare nessuno dei requisiti indicati nell’ordine, invierà all’acquirente all’indirizzo e-mail dell’acquirente un’offerta modificata indicando le possibili varianti dell’ordine e richiederà il parere dell’acquirente.
3.12. L’offerta modificata è considerata una nuova bozza del contratto di acquisto e il contratto di acquisto si conclude in tal caso solo previa accettazione da parte dell’acquirente via e-mail.
3.13. L’acquirente si impegna a utilizzare mezzi di comunicazione a distanza al momento della conclusione del contratto di acquisto. I costi sostenuti dall’acquirente per l’utilizzo dei mezzi di comunicazione a distanza in relazione alla conclusione del contratto di acquisto (costi di connessione a Internet, costi delle telefonate) sono a carico dell’acquirente stesso e questi costi non differiscono da quelli di base Vota.
4. PREZZO DELLA MERCE E TERMINI DI PAGAMENTO
4.1. L’acquirente può pagare al venditore il prezzo della merce e gli eventuali costi connessi alla consegna della merce in base al contratto di acquisto nei seguenti modi:

4.2. Insieme al prezzo di acquisto, l’acquirente è tenuto a pagare al venditore anche le spese relative all’imballaggio e alla consegna della merce nell’importo concordato. Salvo espressa indicazione contraria, il prezzo di acquisto comprende anche i costi connessi alla consegna della merce.
4.3. Il venditore non richiede un deposito o altro pagamento simile da parte dell’acquirente. Ciò non pregiudica quanto previsto dall’articolo 4.6 dei Termini e Condizioni in merito all’obbligo di anticipare il pagamento del prezzo di acquisto della merce.
4.4. Il venditore ha il diritto, soprattutto se l’acquirente non fornisce un’ulteriore conferma dell’ordine (articolo 3.8), di pretendere il pagamento dell’intero prezzo di acquisto prima di inviare la merce all’acquirente. Non si applicano le disposizioni dell’articolo 2119, comma 1, del codice civile.
4.5. Eventuali sconti sul prezzo della merce forniti dal venditore all’acquirente non sono cumulabili tra loro.
4.6. Se è consuetudine nei rapporti d’affari o se è previsto da norme di legge generalmente vincolanti, il venditore emetterà un documento fiscale – una fattura – all’acquirente in merito ai pagamenti effettuati sulla base del contratto di acquisto. Il venditore è il pagatore dell’imposta sul valore aggiunto. Documento fiscale: il venditore emette fattura all’acquirente dopo il pagamento del prezzo della merce e la invia in forma elettronica all’indirizzo e-mail dell’acquirente e allega una copia della merce ordinata.
5. RECESSO DAL CONTRATTO DI ACQUISTO
5.1. L’acquirente prende atto che secondo le disposizioni del § 1837 del codice civile, non è possibile recedere dal contratto di acquisto per la consegna di beni che siano stati modificati secondo la volontà dell’acquirente o per la sua persona
5.2. Se non è il caso menzionato o un altro caso in cui non è possibile recedere dal contratto di acquisto, l’acquirente ha il diritto di recedere dal contratto di acquisto ai sensi del § 1829, comma 1, del codice civile, entro quattordici (14) ) giorni dal ricevimento della merce, mentre nel caso in cui oggetto del contratto di acquisto siano più tipologie di merce o la consegna di più parti, tale termine decorre dalla data di accettazione dell’ultima consegna della merce. Il recesso dal contratto di acquisto deve essere comunicato al venditore entro il termine indicato nella frase precedente.
5.3. Per recedere dal contratto di acquisto, l’acquirente può utilizzare il modulo campione fornito dal venditore, che costituisce un’appendice alle condizioni generali. Il recesso dal contratto di acquisto può essere inviato dall’acquirente all’indirizzo della sede di attività o della sede legale del venditore. Per la consegna del recesso dal contratto si applicano le disposizioni dell’articolo 11 di questi termini e condizioni. L’imprenditore deve confermare la sua accettazione al consumatore in forma di testo senza indebito ritardo.
5.4. In caso di recesso dal contratto di acquisto ai sensi dell’articolo 5.2 dei termini e condizioni, il contratto di acquisto si intende risolto dall’inizio. La merce dovrà essere restituita al venditore entro quattordici (14) giorni dal recesso dal contratto al venditore. Se l’acquirente recede dal contratto di acquisto, l’acquirente si fa carico delle spese relative alla restituzione della merce al venditore, anche se la merce non può essere restituita per via postale per la sua natura.
5.5. In caso di recesso dal contratto ai sensi dell’articolo 5.2 dei termini e condizioni, il venditore restituirà i fondi ricevuti dall’acquirente entro quattordici (14) giorni dal recesso dal contratto di acquisto da parte dell’acquirente, allo stesso modo del il venditore li ha ricevuti dall’acquirente. Il venditore ha anche il diritto di restituire la prestazione fornita dall’acquirente quando la merce viene restituita dall’acquirente o in altro modo, se l’acquirente è d’accordo e senza costi aggiuntivi a carico dell’acquirente. Se l’acquirente recede dal contratto di acquisto, il venditore non è obbligato a restituire i fondi ricevuti all’acquirente prima che l’acquirente gli restituisca la merce o dimostri di aver inviato la merce al venditore.
5.6. Il venditore ha il diritto di compensare unilateralmente la pretesa di risarcimento del danno arrecato alla merce con la pretesa dell’acquirente di rimborso del prezzo di acquisto.
5.7. Fino a quando l’acquirente non prende in consegna la merce, il venditore ha il diritto di recedere dal contratto di acquisto in qualsiasi momento
t. In tal caso, il venditore restituirà il prezzo di acquisto all’acquirente senza indebito ritardo, senza contanti sul conto indicato dall’acquirente.
5.8. Se un regalo viene fornito all’acquirente insieme alla merce, il contratto di regalo tra il venditore e l’acquirente è concluso con la condizione di risoluzione che se l’acquirente recede dal contratto di acquisto, il contratto di regalo relativo a tale regalo cessa di essere efficace e l’acquirente è obbligato a restituire la merce al venditore unitamente all’omaggio fatto.
6. TRASPORTO E CONSEGNA DELLA MERCE
6.1. Spediamo la merce entro e non oltre 5 giorni lavorativi dalla ricezione dell’ordine.
6.2. Nel caso in cui la modalità di trasporto sia contratta sulla base di una richiesta speciale dell’acquirente, l’acquirente si assume il rischio e gli eventuali costi aggiuntivi associati a questa modalità di trasporto.
6.3. Se, in base al contratto di acquisto, il venditore è obbligato a consegnare la merce nel luogo indicato dall’acquirente nell’ordine, l’acquirente è obbligato a prendere in consegna la merce al momento della consegna.
6.4. Se, per motivi da parte dell’acquirente, è necessario consegnare la merce ripetutamente o in modo diverso da quanto specificato nell’ordine, l’acquirente è obbligato a pagare le spese relative alla consegna ripetuta della merce, oppure costi associati a un altro metodo di consegna.
6.5. Al momento della presa in consegna della merce al trasportatore, l’acquirente è tenuto a controllare l’integrità dell’imballo della merce e, in caso di eventuali vizi, a darne immediata comunicazione al trasportatore. In caso di violazione dell’imballaggio che indichi un’intrusione non autorizzata nella spedizione, l’acquirente non è tenuto ad accettare la spedizione dal vettore.
7. DIRITTI DA PRESTAZIONI DIFETTOSE
7.1. I diritti e gli obblighi delle parti contraenti in merito ai diritti da vizio di esecuzione sono disciplinati dalle relative norme generalmente vincolanti (in particolare dalle disposizioni degli articoli da 1914 a 1925, dagli articoli da 2099 a 2117 e dagli articoli da 2161 a 2174 del codice civile).
7.2. Il venditore è responsabile nei confronti dell’acquirente che la merce sia esente da vizi al momento del ricevimento. In particolare, il venditore è responsabile nei confronti dell’acquirente che al momento in cui l’acquirente ha preso in consegna la merce:
7.2.1. la merce ha le proprietà concordate tra le parti e, in mancanza di accordo, ha le proprietà che il venditore o produttore ha descritto o che l’acquirente si aspettava in relazione alla natura della merce e sulla base della pubblicità da loro svolto,
7.2.2. la merce è idonea allo scopo che il venditore dichiara per il suo utilizzo o per il quale vengono normalmente utilizzati beni di questo tipo,
7.2.3. la qualità o il design della merce corrisponda al campione o modello contrattato, se la qualità o il design è stato determinato in base al campione o modello contrattato,
7.2.4. è la merce nella quantità, misura o peso corrispondente e
7.2.5. la merce è conforme ai requisiti delle norme di legge.
7.3. Le disposizioni di cui all’articolo 7.2 dei termini e condizioni non si applicano alla merce venduta ad un prezzo inferiore per un difetto per il quale era stato concordato un prezzo inferiore, all’usura della merce causata dal suo uso abituale, nel caso di merce usata ad un difetto corrispondente al grado di utilizzo o usura che la merce aveva al momento della ricezione da parte dell’acquirente, o se deriva dalla natura della merce.
7.4. Se un difetto si manifesta entro sei mesi dal ricevimento, si considera che la merce fosse già difettosa al momento del ricevimento.
7.5. I diritti da vizio di esecuzione sono esercitati dall’acquirente presso l’indirizzo della sede del venditore, ove è possibile l’accoglimento del reclamo in relazione alla gamma di beni venduti, eventualmente anche presso la sede legale o sede di attività. Il momento in cui il venditore riceve la merce contestata dall’acquirente è considerato momento di presentazione del reclamo.
7.6. Ulteriori diritti e obblighi delle parti connessi alla responsabilità del venditore per vizi possono essere regolati dalla procedura di reclamo del venditore.
8. ALTRI DIRITTI E OBBLIGHI DEI CONTRAENTI
8.1. L’acquirente acquisisce la proprietà della merce pagando l’intero prezzo di acquisto della merce
8.2. In relazione all’acquirente, il venditore non è vincolato da alcun codice di condotta ai sensi delle disposizioni del § 1826 comma 1 lettera e) del codice civile.
8.3. La risoluzione extragiudiziale delle controversie dei consumatori derivanti dal contratto di acquisto è responsabilità dell’Ispettorato commerciale ceco, con sede legale in Štěpánská 567/15, 120 00 Praga 2, numero ID: 000 20 869, indirizzo Internet: http: //www.coi.cz

8.5. L’acquirente si assume il rischio di un cambiamento delle circostanze ai sensi del § 1765, paragrafo 2 del codice civile.
9. PROTEZIONE DEI DATI PERSONALI
9.1. La tutela dei dati personali dell’acquirente, che è una persona fisica, è prevista dalla legge n. 101/2000 Coll., sulla protezione dei dati personali, e successive modifiche.
9.2. L’acquirente acconsente al trattamento dei propri dati personali: nome e cognome, indirizzo di residenza, codice fiscale, codice fiscale, indirizzo e-mail, numero di telefono e nickname (di seguito “dati personali”).
9.3. L’acquirente acconsente al trattamento dei dati personali da parte del venditore, ai fini dell’esercizio di diritti e obblighi derivanti dal contratto di acquisto e ai fini del mantenimento di un account utente. Se l’acquirente non sceglie un’altra opzione, acconsente al trattamento personale
ch dati da parte del venditore anche al fine di inviare informazioni e messaggi commerciali all’acquirente. Il consenso al trattamento dei dati personali nella sua interezza ai sensi del presente articolo non è condizione che comporterebbe di per sé l’impossibilità di concludere un contratto di acquisto.
9.4. L’acquirente riconosce di essere obbligato a fornire i suoi dati personali in modo corretto e veritiero (al momento della registrazione, nel suo account utente, al momento dell’ordine dall’interfaccia web del negozio) e di essere tenuto a informare il venditore senza indebito ritardo di una modifica dei suoi dati personali dati.
9.5. Il venditore può affidare il trattamento dei dati personali dell’acquirente a una terza parte in qualità di responsabile del trattamento. A parte le persone che trasportano la merce, i dati personali non saranno mai ceduti a terzi dal venditore.
9.6. I dati personali saranno trattati a tempo indeterminato. I dati personali saranno trattati in forma elettronica in modo automatizzato o in forma cartacea in modo non automatizzato.
9.7. L’acquirente conferma che i dati personali forniti sono esatti e di essere stato informato che si tratta di un conferimento volontario di dati personali.
9.8. Nel caso in cui l’acquirente ritenga che il venditore o il responsabile del trattamento (articolo 9.5) tratti i suoi dati personali in violazione della tutela della vita privata e personale dell’acquirente o in violazione di legge, soprattutto se i dati personali sono inesatti rispetto a per le finalità del loro trattamento, possono:
9.8.1. chiedere spiegazioni al venditore o al responsabile,
9.8.2. richiedere al venditore o al trasformatore di rimuovere la condizione così creata.
9.9. Se l’acquirente richiede informazioni sul trattamento dei suoi dati personali, il venditore è obbligato a fornirgli tali informazioni. Il venditore ha il diritto di richiedere un congruo compenso non eccedente i costi necessari per fornire le informazioni per la fornitura delle informazioni di cui alla frase precedente.
9.10. Il cliente può in qualsiasi momento revocare il proprio consenso al trattamento dei dati personali, nonché annullare in qualsiasi momento l’invio di email pubblicitarie a cui ha già prestato il consenso.
10. INVIO DI MESSAGGI COMMERCIALI E MEMORIZZAZIONE DI COOKIE
10.1. L’acquirente si impegna a inviare informazioni relative a beni, servizi o attività del venditore all’indirizzo e-mail dell’acquirente e accetta inoltre che il venditore invii messaggi commerciali all’indirizzo e-mail dell’acquirente. Può revocare tale consenso in qualsiasi momento.
10.2. L’acquirente acconsente alla memorizzazione dei cosiddetti cookie sul proprio computer. Nel caso in cui sia possibile effettuare un acquisto sul sito e adempiere agli obblighi del venditore derivanti dal contratto di acquisto senza che i cosiddetti cookie vengano memorizzati sul computer dell’acquirente, l’acquirente può revocare in qualsiasi momento il consenso di cui al precedente periodo .
11. CONSEGNA
11.1. Le comunicazioni relative al rapporto tra il venditore e l’acquirente, in particolare per quanto riguarda il recesso dal contratto di acquisto, devono essere consegnate a mezzo raccomandata, salvo quanto diversamente previsto nel contratto di acquisto. Gli avvisi devono essere consegnati all’indirizzo di contatto pertinente dell’altra parte e si considerano consegnati ed efficaci al momento della consegna per posta, salvo avviso di recesso da parte dell’Acquirente, nel qual caso il recesso è efficace se l’avviso è inviato da l’Acquirente entro il periodo di recesso.
11.2. Si considerano consegnati anche gli avvisi la cui accettazione è stata rifiutata dal destinatario, che non sono stati ritirati entro il termine di giacenza, o che sono stati restituiti come non recapitabili.
11.3. Le parti contraenti possono scambiarsi una corrispondenza regolare via e-mail, all’indirizzo e-mail specificato nell’account utente dell’acquirente o specificato dall’acquirente nell’ordine, oppure all’indirizzo indicato sul sito web del venditore.
12. DISPOSIZIONI FINALI
12.1. Se il rapporto stabilito dal contratto di acquisto contiene un elemento internazionale (estero), le parti concordano che il rapporto è regolato dal diritto ceco. Ciò non pregiudica i diritti dei consumatori derivanti da normative legali generalmente vincolanti.
12.2. Se una qualsiasi disposizione dei termini e condizioni non è valida o inefficace, o lo diventa, la disposizione non valida sarà sostituita da una disposizione il cui significato è il più vicino possibile alla disposizione non valida. L’invalidità o l’inefficacia di una disposizione non pregiudica la validità delle altre disposizioni. Modifiche e integrazioni al contratto di acquisto o ai termini e condizioni richiedono forma scritta.
12.3. Il contratto di acquisto, comprensivo di termini e condizioni, è archiviato dal venditore in forma elettronica e non è accessibile.
12.4. L’allegato ai termini e condizioni è costituito da un modulo campione per il recesso dal contratto di acquisto.

1.3. Положения, отклоняющиеся от условий, могут быть оговорены в договоре купли-продажи. Отклоняющиеся положения в договоре купли-продажи имеют приоритет над положениями условий.
1.4. Условия являются неотъемлемой частью договора купли-продажи. Договор купли-продажи и условия составлены на чешском языке. Договор купли-продажи может быть заключен на чешском языке.
1.5. Формулировка условий может быть изменена или дополнена продавцом. Данное положение не влияет на права и обязанности, возникающие в период действия предыдущей редакции условий.
2. УЧЕТНАЯ ЗАПИСЬ ПОЛЬЗОВАТЕЛЯ
2.1. На сайте оператора интернет-магазина, spol. Ла Кандела с.р.о. для покупки не требуется обязательной регистрации, введенные данные всегда и только используются для обработки самого заказа и никогда не передаются третьим лицам, за исключением оператора почтовых/транспортных услуг.
3. ЗАКЛЮЧЕНИЕ ДОГОВОРА КУПЛИ
3.1. Все представленные товары, размещенные в веб-интерфейсе магазина, носят информативный характер и продавец не обязан заключать договор купли-продажи в отношении этих товаров. Положения пункта 2 статьи 1732 Гражданского кодекса не применяются.
3.2. Веб-интерфейс магазина содержит информацию о товарах, включая цены на отдельные товары. Цены на товары указаны с учетом налога на добавленную стоимость и всех сопутствующих расходов, за исключением почтовых расходов. Цены на товары остаются действительными на время их отображения в веб-интерфейсе магазина. Это положение не ограничивает возможности продавца заключить договор купли-продажи на индивидуально согласованных условиях.
3.3. Веб-интерфейс магазина также содержит информацию о расходах, связанных с упаковкой и доставкой товаров в перечисленные страны, включая Чешскую Республику, Словакию, страны ЕС и страны, не входящие в ЕС.
3.4. Для заказа товара покупатель заполняет форму заказа в веб-интерфейсе магазина. Форма заказа в основном содержит информацию о:
3.4.1. заказанный товар (заказанный товар «кладется» покупателем в электронную корзину веб-интерфейса магазина),
3.4.2. способ оплаты покупной цены товара, информацию о необходимом способе доставки заказанного товара и

3.5. Перед отправкой заказа продавцу покупателю разрешается проверять и изменять данные, введенные покупателем в заказе, в том числе с учетом возможности обнаружения и исправления покупателем ошибок, возникших при вводе данных в заказ. Покупатель отправляет заказ продавцу, нажав кнопку «Подтвердить заказ». Информация, указанная в заказе, считается продавцом правильной, и заказ всегда считается обязывающим.
3.6. Отправка заказа считается действием покупателя, однозначно идентифицирующим заказанный товар, покупную цену, личность покупателя, способ оплаты покупной цены, и является обязательным для исполнения проектом договора купли-продажи. стороны. 3.12. Измененное предложение считается новым проектом договора купли-продажи, и договор купли-продажи в таком случае считается заключенным только после принятия покупателем по электронной почте.
3.13. Покупатель соглашается использовать дистанционные средства связи при заключении договора купли-продажи. Расходы, понесенные покупателем при использовании средств связи на расстоянии в связи с заключением договора купли-продажи (расходы на подключение к Интернету, расходы на телефонные переговоры) оплачиваются покупателем самостоятельно, и эти расходы не отличаются от основных оценивать.
4. ЦЕНА ТОВАРА И УСЛОВИЯ ОПЛАТЫ
4.1. Покупатель может оплатить цену товара и любые расходы, связанные с доставкой товара по договору купли-продажи продавцу, следующими способами:

4.3. Продавец не требует от покупателя залога или иного подобного платежа. Это не влияет на положения статьи 4.6 Условий в отношении обязательства оплатить покупную цену товара заранее.
4.4. Продавец вправе, особенно если покупатель не предоставляет дополнительного подтверждения заказа (п. 3.8), потребовать оплаты всей покупной цены до отправки товара покупателю. Положения пункта 1 статьи 2119 Гражданского кодекса не применяются.
4.5. Любые скидки с цены товара, предоставляемые продавцом покупателю, не могут быть объединены между собой.
4.6. Если это принято в деловых отношениях или если это предусмотрено общеобязательными правовыми нормами, продавец выдает покупателю налоговый документ – счет-фактуру в отношении платежей, произведенных на основании договора купли-продажи. Продавец является плательщиком налога на добавленную стоимость. Налоговый документ – продавец выставляет счет покупателю после оплаты цены товара и отправляет его в электронном виде на адрес электронной почты покупателя и прикрепляет копию к заказанному товару.
5. ОТКАЗ ОТ ДОГОВОРА КУПЛИ
5.1. Покупатель признает, что в соответствии с положениями § 1837 Гражданского кодекса невозможно отказаться от договора купли-продажи на поставку товаров, которые были изменены в соответствии с пожеланиями покупателя или для его лица.
5.2. Если это не упомянутый случай или другой случай, когда невозможно отказаться от договора купли-продажи, покупатель имеет право отказаться от договора купли-продажи в соответствии с § 1829, пункт 1 Гражданского кодекса, в течение четырнадцати (14) ) дней получения товара, при этом в случае, если предметом договора купли-продажи является несколько видов товара или поставка нескольких частей, этот срок исчисляется с даты приемки последней поставки товара. 5.3. Для отказа от договора купли-продажи покупатель может использовать образец формы, предоставленный продавцом, который является приложением к условиям. Положения статьи 11 настоящих условий применяются к доставке отказа от договора. Предприниматель должен подтвердить свое принятие потребителю в текстовой форме без неоправданной задержки.
5.4. В случае отказа от договора купли-продажи в соответствии со статьей 5.2 условий договор купли-продажи аннулируется с самого начала. Товар должен быть возвращен продавцу в течение четырнадцати (14) дней с момента отказа от договора с продавцом. Если покупатель отказывается от договора купли-продажи, покупатель несет расходы, связанные с возвратом товара продавцу, даже если товар не может быть возвращен обычным почтовым маршрутом из-за его характера.
5.5. В случае отказа от договора в соответствии со статьей 5.2 условий, продавец возвращает денежные средства, полученные от покупателя, в течение четырнадцати (14) дней с момента отказа от договора купли-продажи покупателем, таким же образом, как и продавец получил их от покупателя. Продавец также имеет право на возврат предоставленного покупателем исполнения при возврате товара покупателем или иным способом, если покупатель согласен и с покупателем не понесены дополнительные расходы. Если покупатель отказывается от договора купли-продажи, продавец не обязан возвращать покупателю полученные денежные средства до того, как покупатель вернет ему товар или докажет, что он отправил товар продавцу.
5.6. Продавец вправе в одностороннем порядке зачесть требование о возмещении ущерба, причиненного товару, против требования покупателя о возврате покупной цены.
5.7. Пока покупатель не примет товар, продавец имеет право отказаться от договора купли-продажи в любое время.
